Location Address App – Terms and Conditions

1. Introduction

Welcome to Location Address App (the “App”). These Terms and Conditions (“Terms”) govern your access to and use of the App, our website (if any), and any related services (together, the “Service”).

By downloading, installing, accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

“You” or “your” means the person using the Service. “We”, “us” or “our” refers to the owner and operator of Location Address App.


2. Eligibility

You may use the Service only if:

  1. You are at least 16 years old (or the minimum age required in your country to consent to online services);
  2. You have the legal capacity to enter into a binding contract; and
  3. You comply with these Terms and all applicable laws and regulations.

If you use the Service on behalf of another person or organisation, you confirm that you are authorised to do so and that they agree to be bound by these Terms.


3. Description of the Service

Location Address App allows users to:

  • View and use location and address information;
  • Access live location data from their device while using the App;
  • Record, save and manage journeys or routes (“Trips”); and
  • Share Trips with selected other users, and in future potentially make certain Trips available publicly.

There are two main user types:

  1. Standard Users (Free) – By default, your location data is stored only on your device and is not uploaded to our servers, except when you choose to record and save a Trip.
  2. Pro Users – For Pro accounts, your location points may be stored in your user profile on our servers to enable Pro features (for example, cloud backup or multi‑device access).

Only Trips are stored in a shared location that can be accessed by others when you choose to share them. You can share a Trip by:

  • Adding other users directly to that Trip; or
  • (Future feature) making the Trip publicly available for others to view or purchase access to.

The purchase / paid public Trips feature is under development and is currently not available. At present, only Trips shared directly and free of charge with other users are supported.

We may modify, suspend or withdraw any part of the Service at any time.


4. Location Data and Privacy

4.1 Live Location Access

The App may request access to your device’s location services to obtain your live location. This may occur:

  • While you are actively using the App; and/or
  • When you have explicitly enabled background tracking, where supported by your device and settings.

You can manage location permissions through your device’s settings. If you disable location permissions, some or all features of the App may not function.

4.2 Storage of Location Data

  • Standard Users
    • Your live location is used to provide functionality while you are using the App but is not stored on our servers by default.
    • Location data is stored only on your device except where you deliberately record and save a Trip.
  • Pro Users
    • In addition to device storage, your location points may be uploaded to and stored in your user profile on our servers to provide Pro features.
    • We store only the data necessary for these features and retain it in line with our data retention practices.

4.3 Trips

A “Trip” may include a series of location points, timestamps, route information and associated metadata. When you create and save a Trip:

  • The Trip is stored and linked to your account;
  • You can keep it private, share it with specific users, or (in future) make it publicly available for others to access or purchase, subject to these Terms and applicable laws.

4.4 Data Sharing and Access

  • Direct Sharing: When you add other users to a Trip, those users can view the Trip and related information you provide.
  • Public/Purchasable Trips (future): Once this feature is launched, Trips that you choose to make public or available for purchase may be visible and accessible to a wider audience. This feature is not currently enabled.

4.5 Privacy Policy

Further details about how we collect, use and protect personal data, including location data, are set out in our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge and agree to the Privacy Policy.


5. Acceptable Use and Content Rules

You are responsible for all content and information you provide through the Service, including any data, descriptions, names and images linked to Trips (“User Content”).

You agree that you will not:

  1. Upload, store, share or link to:
    • Any explicit, pornographic or sexually suggestive images or content;
    • Any violent, abusive, threatening, hateful, discriminatory or otherwise unlawful content;
    • Any advertising, marketing, spam or promotional material that is not directly related to the Trip itself.
  2. Include in Trip details any content that is not reasonably relevant to the Trip, its route, or practical information about the journey.
  3. Use the Service to harass, stalk, intimidate or otherwise invade the privacy or safety of any person, including by misusing location data.
  4. Misrepresent your identity or affiliation, or impersonate others.
  5. Interfere with or disrupt the Service, its servers or networks, including by introducing viruses, malware or harmful code.
  6. Use any automated means (bots, scrapers, etc.) to access or collect data from the Service without our prior written consent.

We reserve the right, but not the obligation, to monitor use of the Service and to remove or restrict access to any User Content that we reasonably believe breaches these Terms or applicable law, and to suspend or terminate accounts where appropriate.


6. User Content and Licence

6.1 Ownership

You retain ownership of any User Content you create, upload or share through the Service.

6.2 Licence to Us

By using the Service and uploading or creating User Content, you grant us a non‑exclusive, worldwide, royalty‑free licence to use, host, store, reproduce, modify, display and distribute such User Content solely for the purposes of operating, maintaining, improving and providing the Service (including to show Trips to users with whom you share them, and in future to make public Trips available where you choose to do so).

This licence will continue for as long as your User Content is stored within the Service, subject to any legal obligations we may have to retain certain data.

6.3 Responsibility for User Content

You are solely responsible for ensuring that your User Content:

  • Complies with these Terms and all applicable laws;
  • Does not infringe any third‑party rights, including copyright, privacy and data protection rights; and
  • Does not contain personal or sensitive information about others without their consent.

7. Pro Accounts and Paid Features

Some features of the Service may be available only to users who subscribe to a Pro plan or otherwise upgrade their account. These may include, for example:

  • Server‑side storage of your location points;
  • Enhanced Trip management and sharing features;
  • Additional tools or analytics.

Details of Pro features, prices, payment terms and cancellation policies will be provided in the App or on our website and may be updated from time to time in accordance with applicable consumer law.

At present, the Trip purchase / marketplace functionality is under development and not yet active. No paid public Trips are currently available.


8. Intellectual Property Rights

All intellectual property rights in the Service (excluding your User Content) are owned by us or our licensors. These include the App software, design, graphics, logos, trade marks, and all other text and materials.

You are granted a limited, non‑exclusive, non‑transferable licence to install and use the App on your personal device solely for your own use in accordance with these Terms.

You must not:

  • Copy, adapt, modify, distribute, sell, lease or create derivative works of any part of the Service;
  • Attempt to reverse engineer, decompile, disassemble or otherwise derive the source code of the App, except where permitted by law.

9. Disclaimers

While we aim to provide a reliable and useful Service, you acknowledge that:

  • The Service is provided on an “as is” and “as available” basis.
  • We do not guarantee that the Service will be uninterrupted, free from errors or secure at all times.
  • Location and routing information may be approximate or inaccurate and may be affected by GPS reception, device sensors, software settings, or network conditions.
  • The Service is intended as an aid only and is not a substitute for your own judgement, local knowledge, or compliance with road, traffic and safety regulations.

You are responsible for your own safety and the safety of others when travelling or following any Trip information.

Nothing in these Terms affects any statutory rights you may have as a consumer under UK law.


10. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any other liability that cannot be excluded or limited under applicable law.

Subject to the above, and to the fullest extent permitted by law:

  1. We shall not be liable for any indirect, consequential or special loss or damage, or for any loss of profit, revenue, data, goodwill or business opportunity arising out of or in connection with your use of the Service.
  2. Our total aggregate liability to you for all claims arising out of or in connection with the Service and these Terms shall not exceed the greater of:
    • the amount (if any) you have paid to us for Pro or paid features of the Service in the 12 months preceding the event giving rise to the claim; or
    • £50.

11. Termination and Suspension

We may suspend or terminate your access to the Service, or remove User Content, if:

  • You materially or repeatedly breach these Terms;
  • We are required to do so by law, court order or the request of a competent authority; or
  • We discontinue or materially change the Service.

You may stop using the Service at any time and, where applicable, you may request deletion of your account and associated data in accordance with our Privacy Policy.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that are intended to survive termination (including sections on intellectual property, disclaimers, limitation of liability and governing law) shall continue in effect.


12. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in law or in the Service. When we do so, we will change the “Last updated” date above and, where appropriate, provide you with notice within the App or by other reasonable means.

If you continue to use the Service after any updated Terms come into effect, you will be deemed to have accepted them. If you do not agree to the changes, you must stop using the Service.


13. Governing Law and Jurisdiction (Scotland)

These Terms, and any dispute or claim (including non‑contractual disputes or claims) arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of Scotland.

If you are a business user, you and we agree that the courts of Scotland shall have exclusive jurisdiction to settle any such dispute or claim.

If you are a consumer resident in the UK or the EEA, you may bring legal proceedings in relation to the Service in the courts of Scotland or, if different, the part of the UK or EEA state in which you live.

Who we are

The Location App is build by PBI Pro Data Services using Googles Firebase and Flutter, then shared on the Android and IOS platforms. PBI Pro data services, is a application development company, looking to build tools to help analytics apps. Included in that is developing apps to help capture data.

Media

The images you save, are also stored in Google Firebase infrustructure. They are stored under your profile, and cannot be seen publicly. At this point there is no Location Sharing, other than the links.

Cookies

Google Firebase will use certain type of “cookies” for authentication. We do not install or use Google Analytics or other advertising features. We only store the Pro Users – user details, so we can see who has a subscription and store their saved locations on the cloud for them to use multiple devices.

Who we share your data with

We use Googles Firebase to store your data. This is only storing your access.

How long we retain your data

We use Google’s Firebase to keep your app data safe. Firebase uses secure, encrypted connections to protect your information. It also manages who can access the app, following Google’s strict security rules.

Free App Users: If you only use the free version of our app, we don’t store any of your personal data.

Pro App Users: If you’re a Pro user and want your data removed, you can use our “Cancel” feature. This will delete your data and cancel your subscription.

Please note: Depending on when you signed up and canceled, your data might temporarily exist in backups. These backups are overwritten and permanently deleted within 30 days.

What rights you have over your data

Following GDPR rules, you can simply cancel your subscription and we will remove your data. If you want extracts of your data please submit a email to the support@pbiprodataservices.com.

Where your data is sent

Visitor comments may be checked through an automated spam detection service.

What data breach procedures we have in place

We do our best to secure our servers through technologies that are there. Better yet, we do our best to not hold information that is not needed.
